Welcome to Kevala Yoga & Wellness. This website and our related services are operated by Kevala Yoga Fitness Inc., doing business as Kevala Yoga & Wellness (“Kevala Yoga,” “we,” “us,” or “our”).
These Terms of Use apply to your use of kevalayoga.ca, your Kevala Yoga account, and purchases made through our website. By using the website or purchasing our services, you agree to these Terms and any additional terms presented to you for a particular membership, package, workshop, training, appointment, event, or other service.
Nothing in these Terms limits any rights or remedies you may have under applicable consumer protection or other laws.
1. Website Use
You may use this website only for lawful purposes.
You agree not to interfere with the operation or security of the website, attempt unauthorized access to accounts or systems, misuse website content, or use the website in a manner that could harm Kevala Yoga or other users.
We may update, suspend, or discontinue portions of the website when reasonably necessary.
2. Accounts
Certain services require a customer account.
You are responsible for providing accurate information and for keeping your account credentials confidential. Please notify us promptly if you believe your account has been accessed without authorization.
We may suspend or restrict an account where reasonably necessary because of misuse, non-payment, fraudulent activity, safety concerns, or serious violations of our studio policies.
3. Memberships, Packages and Services
Memberships, class packages, workshops, teacher trainings, events, appointments, retreats, and other services may be subject to additional terms disclosed at the time of purchase.
Where a separate Membership Agreement, registration agreement, cancellation policy, waiver, or other service-specific agreement applies, that agreement forms part of your contract with Kevala Yoga.
If there is a conflict between these general Terms and service-specific terms, the service-specific terms will apply to that service, subject to applicable law.
4. Membership Commitments and Renewals
Where you purchase a membership with a stated commitment period, you agree to the payment obligations applicable to that commitment, subject to any cancellation or other rights provided by law.
Cancellation, renewal, hold, billing, and notice requirements for a particular membership will be stated in the applicable Membership Agreement or purchase terms.
Any automatic renewal will be administered in accordance with applicable British Columbia consumer protection laws.
Nothing in these Terms limits statutory cancellation rights available to consumers.
5. Payments
All prices are stated in Canadian dollars unless otherwise indicated.
You authorize us and our payment service providers to process charges associated with purchases you make.
You are responsible for maintaining valid payment information for recurring memberships or payment plans.
Your financial institution or card provider may impose additional fees, currency conversion charges, or other charges that are outside Kevala Yoga's control.
Where a payment is declined or returned, we may contact you to arrange payment and may temporarily suspend access to services until the outstanding amount is resolved.
Any administrative fee relating to a failed payment will only apply where it has been disclosed to you as part of the applicable purchase or membership terms.
6. Refunds and Cancellations
Unless otherwise stated at the time of purchase, memberships, class packages, workshops, teacher trainings, events, and appointments are generally non-refundable after any applicable cancellation period has expired.
This policy is always subject to cancellation, refund, and other rights provided by applicable law.
If Kevala Yoga cancels a paid service and does not provide a reasonable replacement, credit, rescheduling option, or other agreed solution, an appropriate refund or credit may be provided.
Memberships and packages are for the registered purchaser and may not be transferred unless Kevala Yoga agrees otherwise in writing.
7. Merchandise
Unused merchandise may be returned within 4 days of purchase, provided it is in its original condition and is otherwise eligible for return.
Certain products may be non-returnable for hygiene, health, safety, or other reasonable reasons disclosed at purchase.
Any rights available under applicable consumer law continue to apply.
8. Class Cancellation and No-Show Policy
For in-studio classes where a waitlist applies, cancellations should be made at least 4 hours before the scheduled start time.
For drop-ins and class-card users, a late cancellation or no-show may result in loss of the applicable class credit.
Members with unlimited-class access may be charged a $20 late cancellation or no-show fee where this policy applies.
A reservation that has not been cancelled before the class begins may be treated as a no-show.
This policy helps us make limited studio spaces available to members who are waiting to attend.
9. Schedule and Instructor Changes
Class schedules, instructors, room arrangements, programming, and other operational details may occasionally change.
We will make reasonable efforts to communicate significant changes where appropriate.
Nothing in this section limits any cancellation or other right that may arise under applicable law where a material change is made to contracted services.
10. Studio Rules and Conduct
Participants are expected to follow reasonable studio rules relating to safety, respectful conduct, use of facilities, punctuality, cleanliness, equipment, and consideration for other participants.
Kevala Yoga may refuse participation or suspend access where reasonably necessary because of unsafe, abusive, disruptive, fraudulent, or seriously inappropriate conduct.
Any termination of a contractual membership remains subject to the applicable agreement and applicable law.
11. Health and Participation
Yoga, heated yoga, Pilates, strength training, movement practices, workshops, retreats, and other physical activities involve physical exertion and may not be appropriate for every individual.
You are responsible for deciding whether a particular activity is suitable for you and for obtaining appropriate medical advice where necessary.
Please inform the instructor of relevant limitations where appropriate and participate within your own abilities.
Additional waivers, acknowledgements, or informed-consent forms may apply to particular activities.
Information provided by Kevala Yoga is for general educational and wellness purposes and is not a substitute for individualized medical diagnosis or treatment.
12. Intellectual Property
The content on this website, including text, course materials, photographs, videos, graphics, logos, branding, training materials, manuals, and other original material, is owned by or licensed to Kevala Yoga Fitness Inc. and is protected by applicable intellectual property laws.
You may use materials provided to you for your own personal learning unless otherwise stated.
You may not reproduce, distribute, publish, sell, record, upload, commercially exploit, or substantially copy our materials without prior written permission.
13. Third-Party Services
Our website may use or link to third-party services, including technology platforms, payment processors, video platforms, social media platforms, and other service providers.
Their services may be governed by their own terms and privacy policies.
We are not responsible for the content or operation of unaffiliated third-party websites or services, except to the extent responsibility cannot lawfully be excluded.
14. Website Information
We make reasonable efforts to keep website information accurate and current.
Occasional errors, omissions, outdated information, or technical problems may occur. If we discover a material error affecting a purchase or registration, we will take reasonable steps to correct it.
15. Limitation of Liability
To the extent permitted by law, Kevala Yoga Fitness Inc. is not responsible for indirect, incidental, special, or consequential losses arising solely from use of the website.
Nothing in these Terms excludes or limits liability or consumer rights where such liability or rights cannot lawfully be excluded or limited.
Any separate participant waiver or service-specific agreement applies according to its own terms and applicable law.
16. Privacy
Our collection, use, disclosure, retention, and protection of personal information is described in our Privacy Policy.
17. Changes to These Terms
We may update these Terms from time to time to reflect changes to our services, operations, or legal requirements.
Changes to these website Terms will apply prospectively from the date they are posted unless otherwise permitted by law.
Changes to an existing membership or other consumer contract will be made only in accordance with the applicable agreement and applicable law.
18. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada.
Any dispute may be brought before a court or other dispute-resolution body having jurisdiction under applicable law.
Nothing in these Terms prevents a consumer from exercising rights available under British Columbia consumer protection legislation.
